Terms and Conditions

Welcome to Joyful Noise Beginning Band. By purchasing or participating in our community membership (“Joyful Noise Band Crew”) or group coaching programs (“Summer Music Program”), you agree to these Terms and Conditions. Please read them carefully.

1. Services:
• Community Membership: The Joyful Noise Band Crew provides access to an online community for 4th–6th grade band students, including monthly live Band Jams, forums, tutorials, and music content, available at $10/month or $100/year (Founding Rate until June 15, 2025, then $14/month or $140/year).
• Group Coaching Programs: Live, instructor-led sessions (e.g., Summer Beginning Band Bootcamp, Percussion Group) priced at $89 each, with add-ons at $59, or bundles including community membership.
• We reserve the right to modify content, schedules, or pricing with 30 days’ notice via email or website announcement.
2. Payment and Subscription:
• Founding Rate: Customers subscribing before June 15, 2025, lock in $10/month or $100/year for the Joyful Noise Band Crew as long as the subscription remains active.
• Auto-Renewal: Subscriptions (monthly or annual) automatically renew unless canceled at least 24 hours before the renewal date. You authorize recurring charges to your payment method.
• Add-Ons/Bundles: Coaching add-ons ($59) require a primary purchase (coaching or community). Bundles may include a 1-month free community trial, auto-renewing at $10/month thereafter.
• Payments are processed via Stripe or Kajabi Payments. You’re responsible for all charges, including any applicable taxes (none currently collected in Illinois).
3. Cancellation and Refunds:
• Community Membership: Cancel anytime in your Kajabi account. No refunds for partial months or years; access continues until the billing period ends.
• Group Coaching Programs: See Section 10 for specific refund policies.
• Free Trial: The 1-month free community trial requires no payment upfront but auto-renews at $10/month unless canceled before the trial ends.
4. Customer Responsibilities:
• You must be 18+ or have parental consent to purchase. Parents/guardians are responsible for minors’ use of our services, including ensuring compliance with the Children’s Online Privacy Protection Act (COPPA) for children under 13.
• Provide accurate payment and contact information. Maintain the confidentiality of your account credentials.
• Comply with community guidelines (e.g., respectful behavior in forums, Band Jams), available in the community page.
5. Intellectual Property:
• All content (tutorials, music, videos, coaching materials) is owned by Joyful Noise Beginning Band. You may not reproduce, distribute, or share content without written permission.
• Limited license: You may access content for personal, non-commercial use during your active membership or program.
6. Liability:
• Our services are provided “as is.” We’re not liable for indirect, incidental, or consequential damages (e.g., loss of data, emotional distress).
• You assume risks associated with online participation (e.g., technical issues). We’re not responsible for student outcomes or instrument use.
7. Termination:
• We may suspend or terminate your access for violating these Terms, non-payment, or disruptive behavior, without refund.
• You may terminate by canceling your subscription or program participation.

9. Governing Law and Dispute Resolution:
• These Terms are governed by Illinois law. Disputes shall first be addressed through good-faith mediation in Illinois before proceeding to courts in Illinois.
• You agree to resolve disputes individually, not as part of a class action.
10. Group Coaching Programs:
• Program Details: Our Summer Music Program includes live, instructor-led group coaching sessions (e.g., Summer Beginning Band Bootcamp, Percussion Group, Rock Band: Ukulele/Guitar Group, Rock Band: Piano Group) conducted online via Kajabi Live Room or Zoom, with 4–8 students per group, lasting 40 minutes weekly for 6 weeks (June 16–July 25, 2025).
• Recordings: All group coaching sessions are recorded to provide temporary access to enrolled students and for our internal quality assurance, training, or future educational content creation. Recordings may include video, audio, or chat interactions.
• Student Access: Enrolled students (or their parents/guardians) may access recordings via their Kajabi account for 1 month after the program ends (until August 25, 2025). Access is revoked thereafter, and recordings are not downloadable.
• Privacy and Ethical Use: We prioritize your child’s privacy. Student identities (e.g., names, faces, voices) will be anonymized or excluded in any recordings used for future content (e.g., promotional materials, courses), except for the instructor’s (Stacey Lusk) identity. Recordings are stored securely and used ethically, solely for educational purposes. We will not share identifiable student information without parental consent, except as required by law.
• Consent: By enrolling, you consent to your child’s participation in recorded sessions and our use of anonymized recordings for educational purposes. Parents/guardians may opt out of recording use (excluding temporary student access) by emailing [email protected]  before the first session.
• Payment Policy: Full payment ($89 per program, $59 for add-ons, or bundle prices) is required upfront at checkout. Payments are non-reimbursable, even if a student misses sessions, as recordings are available for 1 month post-program to ensure access to lesson content.
• Cancellations and Rescheduling:
• Student Cancellations: No refunds are issued for missed sessions or program withdrawals after the first session (June 16, 2025). Cancellations before June 16 are eligible for a refund minus a $25 processing fee, if requested within 7 days of purchase.
• Instructor Cancellations: If we cancel a session (e.g., due to instructor unavailability), we will schedule a make-up session at a mutually agreeable time before or after the program’s end date. If a make-up is not feasible, a prorated refund (1/6 of the program fee, ~$14.83) will be issued for the missed session.
• Technical Requirements: You are responsible for ensuring a stable internet connection, compatible device, and appropriate software (e.g., Zoom) for participation. We are not liable for technical issues beyond our control.
